Aryan Khan and Aachit Kumar played online poker, chats not about drugs: Lawyer tells court

According to Aachit Kumar’s lawyers, he and Aryan Khan used to play online poker (PTI photo) The special court under the Narcotic Drugs and Psychotropic Substances (NDPS) Act has reserved it’s order on the bail plea of Aryan Khan’s friend Aachit Kumar.

Kumar’s bail plea was argued by advocate Ashwin Thool, who said that it was a case of illegal detention, and that the agency is unnecessarily trying to label him as a drug peddler while he was only found with small quantity of drug which was to be used for personal consumption.

The NCB had vehemently opposed the bail plea of Aachit Kumar. Special Public Prosecutor Advait Sethna had argued that there were WhatsApp messages between Aryan Khan and him, including discussions around contraband.

According to Kumar’s lawyers, the conversation between Kumar and Aryan Khan revolve around an online poker game. The two are said to be friends. The two used to play online poker and the conversations are with regards to certain winnings in that game, which is now being shown as ‘transaction’ by the agency. They say that the conversations have nothing to do with contraband recovered during the cruise rave party raid on October 2 and 4 by the NCB.

Meanwhile, Judge V V Patil heard bail plea of two other accused on Tuesday. Advocate Ayaz Khan, appearing for accused Nupur Satija, argued that the search of the cruise cabin, personal effects and personal search was effected by the panch witness.

“As per the law, a panch is not empowered to search and recover contraband. It has to be done by officers empowered by the NDPS Act. They have to be of and above the rank of intelligence officer,” argued Khan, pointing to the procedural lapses at the time of arrest of accused.

He further added, “They [NCB officials] entered the room post sunset at 7.50 pm and they exited the room along with her around 9.30 pm. Her movements thereafter were restricted and she was taken into the NCB office. This amounts to arrest […]
